By accessing or using Fluence ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.
2. Description of Service
Fluence is an AI-powered content creation platform that allows users to create AI personas and generate images for social media and marketing purposes. The service includes:
- Creating and managing AI personas with custom appearances and personalities
- Generating images using artificial intelligence
- Managing and exporting generated content
- Subscription-based access to premium features and credits
3. Account Registration
You must sign in with Apple to use Fluence. You are responsible for maintaining the security of your account and for all activities that occur under your account.
4. Subscriptions and Payments
Fluence offers subscription plans and credit packs for purchase. All purchases are processed through Apple's App Store and are subject to Apple's terms and conditions.
- Subscriptions automatically renew unless cancelled before the renewal date
- Credits do not expire and are non-refundable
- Subscription management and cancellation is handled through your Apple ID settings
5. Acceptable Use
You agree not to use Fluence to:
- Generate illegal, harmful, or offensive content
- Create content that infringes on intellectual property rights
- Impersonate real individuals without consent
- Generate explicit, violent, or hateful imagery
- Distribute spam or misleading content
- Attempt to circumvent usage limits or security measures
We reserve the right to suspend or terminate accounts that violate these guidelines.
6. Intellectual Property
Your Content
You retain ownership of the content you create using Fluence, including generated images and captions. By using our service, you grant us a limited license to process and store your content solely for providing the service.

Fluence and its original content, features, and functionality are owned by us and are protected by copyright, trademark, and other intellectual property laws.
7. AI-Generated Content
Content generated by our AI is created using machine learning models. While we strive for quality and consistency, we do not guarantee that generated content will meet specific requirements or be free from errors. You are responsible for reviewing and approving all content before use.
8. Limitation of Liability
To the maximum extent permitted by law, Fluence shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of the service.
9. Disclaimer of Warranties
The service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, secure, or error-free.
10. Termination
We may terminate or suspend your account at any time for violations of these terms. Upon termination, your right to use the service ceases immediately. You may delete your account at any time through the app's Settings.
11. Changes to Terms
We reserve the right to modify these terms at any time. We will notify users of significant changes. Continued use of the service after changes constitutes acceptance of the new terms.
12. Governing Law
These terms shall be governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to conflict of law provisions.
